The Prevention Bill cleared on Wednesday the Lower House plenum by a vote of 177 to 26.

The bill regulates particular instruments that ensure the prevention of offences.

“To this effect, the authorities/public institutions responsible for controlling, acknowledging and sanctioning offences are tasked with informing, instructing and guiding the public and are also required to enforce the sanction by warning in the case of certain offenses, along with establishing a remedial plan giving the offender a period of time to meet his legal obligations. The piece of legislation is aimed at enhancing the preventive role of control, as well as at ensuring juridical security against the backdrop of a rising amount of legislation and of the emergence of new regulatory areas,” the substantiation note states.

The bill provides that all the authorities and institutions with responsibilities for controlling, acknowledging and sanctioning offences are required to work out and disseminate, in three months after the law’s coming into effect, documentary materials and guidelines and have special sections on their webpages dedicated to public information on the legislation in force, the rights and obligations in carrying out offence-finding activities and enforcing sanctions.

The authorities competent for exerting control are required to direct the persons interested in the correct and consistent enforcement of the legal provisions and to display on their websites the most frequent cases and the guidance solutions in these cases.

The central public administration authority responsible for the nationwide coordination of the business environment is required to create in six months a dedicated information portal.

In the event one of the offences stipulated in the legal provisions is found, the investigating agent concludes a report thereon and sanctions it with warning having also a remedial plan attached, in compliance with the provisions of the present law. No complementary sanctions shall be applied in this situation.

The Chamber of Deputies is the decision-making body for this bill.
