Road Company to pay EUR 1 M damages to accident victim who lost arm


The Romanian National Company for Motorways and National Roads (CNADNR) assured that it will observe and apply the decision of the High Court of Cassation and Justice (ICCJ), which granted a compensation of one million euros for moral damages to a young woman who lost her right arm in a road accident in 2006.
‘CNADNR has taken note of the decision of the High Court of Cassation and Justice, will abide to it and apply it as such. The National Company for Motorways and National Roads expresses its compassion towards the drama experienced by the victim’, reads a CNADNR release received by Agerpres on Wednesday.
After her road accident, Georgiana Elena Ghegeliu sued CNADNR at the Bucharest Tribunal; in April 2013, the court ruled that the young woman is entitled to a one million euros compensation for moral damages. CNADNR appealed this decision, and the Bucharest Court of Appeals reduced the sum to 200,000 euros.
Ghegeliu filed another appeal; the High Court of Cassation and Justice admitted it on Wednesday, and ruled that the compensation is one million euros.
The accident that sparked the case occurred in 2006, while the woman was travelling to Brasov (central Romania) in her boyfriend’s car. The latter was driving; he veered right to avoid the impact of another car that entered their lane from the opposite direction; the victim’s vehicle hit a metal barrier on the side of the road. A fragment of the barrier pierced the passenger door and struck her hand. Ghegeliu was taken to a hospital, where doctors amputated her right arm.
The court found the administrator of the road responsible for the injuries, as it failed to repair the road safety elements on that road section.
