The President of the Constitutional Court of Romania (CCR), Augustin Zegrean, on Thursday stated that murders cannot be prescribed, neither the criminal liability nor the execution of the sentence. “With a majority of votes, the Court rejected the exception of unconstitutionality of the Article 125 of the Criminal Code. More concretely – as it was said in the media – the prescription of crimes committed by torturers can not be taken into consideration. Hence, it will not be applied. Facts can not be prescribed. Or, more precisely, murder cannot be prescribed, neither the criminal liability or the execution of the sentence”, said Zegrean, after the CCR announced its decision to reject as unfounded the exception of unconstitutionality of dispositions related to the elimination of the prescription of execution of sentence in homicide cases.
