Gov’t wants council to curtail number of complaints with ECHR

The Government intends to set up an inter-institutional council whose duty would be to find solutions to reduce the number of complaints filed with ECHR in the conditions in which Romania ranks third, after Russia and Turkey, in regard to the number of complaints about the violation of property. Ministerial sources quoted by Mediafax disclosed on Thursday that some of the measures to be considered by the new council are the modification of the legislation regarding the enforcement of the judicial resolutions at the level of the local and county councils, and the initiation of controls of the fulfillment of the legal obligations in the case of the restitutions at local level, in order to make the prefectures and city halls aware of their responsibilities. The council could propose also the modification of the Law regarding the nationalized houses, after an analysis over this issue, the quoted sources said.


Romania ranks third, after Russia and Turkey, in regard to the number of complaints about the repeated violation of the right to property, as a result of the impossibility to grant money compensations instead of the real estates which cannot be returned in kind. The Romanian state ranked first in 2008 in terms of amount paid as damages further to the loss of the lawsuits in Strasbourg, the Government from Bucharest being forced to pay EUR 12 M to plaintiffs.
