Latest modifications to Labour Code – debated today

All the provisions referring to the unified national collective employment contract are abrogated in the latest form of the Labour Code bill, obtained by Mediafax. This is to be debated today by the prime-minister Emil Boc and Labour Minister Ioan Botis with the trade unions. Some of the articles in the present Code were abrogated. A case at stake is the abrogation of the provision that a collective employment contract be signed on a fixed term, which cannot be shorter than 12 months, or for the term of a finite project. The trial period which can be set to put to the test the employer’s skills, on signing the individual employment contract, is of maximum 90 days, according to the new modifications. At the same time, the individual fixed term employment contract cannot be signed for a term longer than 36 months. Furthermore, labour supply by an individual in the absence of an individual employment contract will be sanctioned by a fine, ranging between RON 500 and 1,000.
