Gov’t to allow authorised natural persons to hire third parties

Authorised natural persons (PFA) will be allowed to hire third parties, under an individual employment contract, to perform the activities for which they are authorised, by modifying the legislation, according to an emergency ordinance currently debated by the Cabinet, Mediafax reports. The legislation in force stipulated that an authorised natural person in not entitled to hire third parties under an employment contract. The government has drafted, however, an emergency ordinance which is to modify this provision, as follows: “The authorised natural person may conduct her activity individually and independently or may hire, as an employer, third parties, under an individual employment contract, registered at the territorial labour inspectorate.” The law also stipulates that the authorised natural person will not be deemed an employer of third parties she collaborates with, even if the collaboration is exclusive.
