Supreme Court rejects recalculation of special pensions

The High Court of Cassation and Justice (ICCJ) on Monday rejected the appeal to the interest of the law against the decision of recalculating special pensions. “Introducing in the analysis an objective element represented either by the social indemnity, or by the social indemnity for pensioners, provided by art. 7 of Law 118/2010, or by the average monthly pension gives a predictable character to solving litigations and maintains a just balance between the general interest and the imperative of protecting fundamental rights,” said the general prosecutor, who filed the appeal.
