New law attacked at CC

PSD attacked yesterday within the Constitutional Court the law that expands disciplinary infringements in the case of magistrates, a law that the Senate adopted on Thursday. According to the note that PSD remitted through a communiqué, the law violates a series of constitutional provisions, including those that establish that Justice is unique, impartial and equal for all and is being made through the High Court of Justice and the other courts established by law. Likewise, according to PSD, the law violates the Constitutional provisions according to which judges are independent and obey only the law and the High Court ensures that the law is unitarily interpreted and applied by all the other courts. Last Thursday the Senate adopted a draft law that expands the sphere of disciplinary infringements in the case of judges and prosecutors and establishes the Judicial Inspection as a juridical entity.
