AmCham: Article II of GEO 55/2013 represents a deviation from the principle of the flat taxation

In the context of the recent publication of GEO 55/2013, the American Chamber of Commerce in Romania (AmCham Romania) underscore several issues regarding the opportunities and content of this GEO, considering that it represents a deviation from the principle of the flat taxation, creating a dangereous precedent and affecting the fiscal stability publicy assumed by the Government maintaing the 16 pc flat tax both for personal and corporate income. “The provisions of Article II of GEO 55/2013 do not observe the principles of fiscal neutrality and equity, imposing different tax rates on several employees’ categories” the communique also reveals. AmCham also mentioned that the lack of clarity in the wording of Article II of the Ordinance raises concerns with the business community as the announced measures are not explicitly limited to the employees of state-owned companies. “In the absence of impact studies for fiscal measures provided by the Ordinance, it is difficult to asses the effects of the GEO on the business environment and on the economy at large. Prior to adopting these changes, no effective public consultations were held.”
