The government should recalculate all the pensions “since 2011” following the decision of the Constitutional Court, which is crazy, Premier Victor Ponta announced, but later he retracted the announcement, after he was told that there is a rectification of the CC, and said that this is good news.
“We are waiting for the motivation of the Court. What the Labour Ministry has almost confirmed to me is that we will have to recalculate the pensions since 2011, which is crazy. Analysing all pensions once again, after we just finished calculating them, everybody knows his pensions – because this is about the pensions cut by the Boc government – and starting to recalculate them, I find this completely crazy, but if this is the decision, we’ll enforce it, although I do not know how this will turn out, there are hundreds of thousands of people… we do not know, because we do not know the precise decision of the Court,” Ponta said, quoted by Mediafax.
When journalists explained him that CC issued a rectification stating that the changes will affect only the pensions that will start being paid in 2013, Ponta backtracked by stating: “Thank God, I am glad because they had a second thought and you gave me the good news!”
The Constitutional Court (CC) ruled Tuesday that art. III para.(2) and (3) of the Emergency Government Ordinance (OUG) 1/2013 that modifies and appends Law 263/2010 on the unitary system of public pensions are unconstitutional. Thursday, the Court explained that it admitted the exception of unconstitutionality of the provisions of art. III paragraphs 2 and 3 of OUG 1/2013 that modify and append the Law of the unitary system of pensions because they infringe the principle of the non-retroactivity of the civil law and, as effect of this decision, the provisions of art. III, para. 1 of OUG 1/2013 referring to the enforcement during 2013 of a correction index of 1.06 to the average annual score determined in line with art. 95 of Law 263/2010 will be applied only to the persons whose pension right was open after the date when OUG 1/2013 was enforced, respectively 23 January 2013.
