Association of Magistrates challenges Morar’s nomination at CCR



The Romanian Association of Magistrates (AMR) appeals to court in the attempt to annul the decree by which President Traian Basescu appointed Daniel Morar as judge of the Constitutional Court of Romania (CCR). According to bursa.ro, AMR filed at the Bucharest Court of Appeals a lawsuit against President Traian Basescu and the Presidential Administration, in which it demands the annulment of the presidential decree which appoints Daniel Morar as CCR judge. According to AMR, the decree is void because the nomination of Daniel Morar at CCR was against the legal provisions on the functioning of the Constitutional Court, which set three conditions of legality for the nomination of a person as CCR judge: superior legal training; high professional competence; and at least 18 years of career in the legal field.
