Basescu asks Parliament to keep article on “pressures on the judiciary” in the Penal Code

President Basescu sent yesterday to Parliament a request of reexamination, asking it to keep Article 276 within the Penal Code. The article incriminates false public statements referring to alleged crimes committed by the judge or by criminal prosecution bodies. The law undergoing promulgation abrogated that article. “This crime is part of the category of crimes against the serving of justice and institutes a protection both for the judge and for the criminal prosecution bodies,” Basescu writes, pointing out that the introduction of this article in the Penal Code had “as the main goal ensuring and protecting the impartiality and freedom of judges and of criminal prosecution bodies in exercising the judiciary prerogatives conferred by law in the face of attempts to intimidate or influence them.” On the other hand, also yesterday, the Head of State promulgated the law that approves the emergency ordinance through which the salaries of mayors will be hiked starting on July 1, 2014.
