Joint use of mobile telephony networks, regulated by the Competition Council

The Competition Council (CC) made public a document which sets the conditions regarding the way companies associate in view of jointly developing and using mobile communication networks, so they do not come under the incidence of competition legislation, the institution announced. Although implementing such arrangements leads to economic efficiency for the involved companies, there is the risk of competition-related problems like the exchange of confidential information that may have as object or effect a coordination of the competition behaviour of the parties into the accord, explains the document. There is also the possibility that the parties adopt, even of a tacit manner, a common policy aimed at denying the access of competitors to the shared elements of infrastructure, as well as reducing the competition between the electronic networks they operate.
