ICCJ published Elena Udrea’s arrest report for Gala Bute: how she used the bribe. Appeal to be tried on March 5

Elena Udrea’s close friends, defendants in the Gala Bute file, had declared that a certain amount of the money received as a bribe for granting contracts supported by the Ministry of Regional Development and Tourism was cashed directly by Elena Udrea, ended up in the patrimony of other persons, at her demand and in her interests, and some of it was used to pay for expenses of the Democrat Liberal Party, especially of the Bucharest branch she had been leading.

The information is presented in the report of the preventive arrest of 30 days sentenced for Elena Udrea in the Gala Bute file, issued by the High Court of Cassation and Justice (ICCJ).

According to Agerpres, the document points out that proof in the file reveals an entire system of corruption coordinated and controlled by Elena Udrea. Through this system, companies that had contracts with the state paid a 10 per cent commission that was quasi-perceivable and quasi-general, almost automatic, and sums cashed by the three companies showed that all payments by the Ministry led to the payment of this commission.

Prosecutors also discovered that these commissions were cashed by persons most close to Udrea, and respectively her personal adviser, her personal assistant Tudor Breazu, her best friend, Ana Maria Topoliceanu, and to Gheorghe Nastasia, her man of confidence, whom she had delegated all attributions within the Ministry.

The report shows that all these persons close to Elena Udrea had showed that the sums of money were destined to her, except for Tudor Breazu.

“The declarations of the persons mentioned above suit the documents that followed the route of some of this money, proving that the final recipient of the money was either the defendant, or other people, but at the demand and based on the interest of defendant Udrea Elena Gabriela, that they were used to pay for expenses of the Democrat Liberal Party and especially at the Bucharest Branch she was leading at that time or entered in the patrimony of Rudel Obreja, in order to pay for the bank loan granted by BRD at the insistence and with the contribution of the defendant”, the report showed.

 

The reason of the arrest: Udrea was pressuring her employees with Gala Bute; they were crying at meetings.

 

Civil servants at the Ministry of Regional Development and Tourism were forced by former minister Elena Udrea to attend endless meetings that lasted long into the night, to find ways to sign contracts for Gala Bute, and some of them even broke into tears, the report of Elena Udrea’s arrest issued by the High Court of Cassation and Justice (ICCJ) on February 25 showed, after Elena Udrea’s 30 day preventive arrest in the Gala Bute File.

During Court discussions, the case prosecutor declared that Elena Udrea had pressured her subordinates to sign the contract on “Gala Bute”, although they had explained her that there were laws preventing the signing of this contract. “The representative of the Public Ministry considers that, based on testimonies of persons questioned in the case, it is undoubted that the defendant (Elena Udrea, editor’s note), although not signing in person, had conceived documents on her own on the adoption of regulating acts that created the context of the offence. Moreover, iit shows that she determined the rest of the civil servants to sign the contract in a forceful way. It is shown in the testimonies by witness Marasoiu and by witness Lungu Stefan who spoke about meetings that lasted until late in the night, as the defendant was imposing civil servants to identify and sign contracts despite of the fact that they were explaining to her the laws preventing these actions. It shows that there where persons who broke into tears during these meetings; this information is found in the testimony by witness Marasoiu, who had resigned his job due to the pressure she had put on him”, the report shows, according to Agerpres.

 

Udrea admitted black money was used in politics, but denied such things in Gala Bute

 

On the other hand, Elena Udrea admitted in front of ICCJ judges that black money was used in politics frequently, nevertheless denying such facts in the “Gala Bute” file.

“She accepts that she had made mistakes as well as a politician, that it may happen in the life of a party that people do things bordering criminal offences during an electoral campaign and that black money is frequently used in politics, but she claims that these aspects have no connection whatsoever with the present cause”, the report shows.

Elena Udrea’s close persons, defendants on their turn in the Gala Bute file, had declared that some of the money received as a bribe for granting contracts financially supported by the Ministry of Regional Development and Justice were either received immediately by Elena Udrea, or ended up in the patrimony of other people, but at Elena Udrea’s demand and in her own interest, or they were used to pay for expenses of the Democrat Liberal Party, especially for those of the Bucharest Branch she was leading at that time.

Appeal to Elena Udrea’s preventive arrest in the Gala Bute file, tried on March 5

 

The High Court of Cassation and Justice scheduled on March 5 the term for trying the appeal submitted by Elena Udrea against preventive arrest.

Elena Udrea was arrested on Wednesday for 30 days. She was charged in the “Gala Bute” file on three accounts of bribe-taking, abuse of office, attempt to use forged, inaccurate or incomplete documents and statement to undeservedly be granted funds from the budget of EU, influence peddling with the purpose of gaining undeserved goods.
