Supreme Court rejects DNA request for the preventive arrest of Constanta Mayor Radu Mazare

The High Court of Cassation and Justice (ICCJ) rejected the National Anti-corruption Directorate (DNA) request for the preventive arrest of Constanta Mayor Radu Mazare, who will not be held in custody while investigated by the prosecutors in a case in which he stands accused with three offenses of bribe taking, two offenses of conflict of interest and abuse of office.

The same decision was made in the case of businessman Sorin Strutinsky, but he is under preventive arrest in another case.

The court decision is not final.

According to the DNA, in the period 2006 – 2009, Radu Mazare, benefiting from the aid of the other defendant, requested and received about 2 million euros from the representatives of two companies, for facilitating the issue of the city planning documents necessary for the development of some mall-type real estate projects, which these companies planned on developing in Constanta.


Mazare , investigated for bribery, abuse of office and conflict of interests


The Mayor of Constanta, Radu Mazare, detained by DNA for bribery, abuse of office and conflict of interests Monday night, was presented before the High Court of Cassation and Justice with the proposal for arrest for 30 days on Tuesday.

Monday night, the prosecutors took him into custody for 24 hours after six hours of questioning at DNA Bucharest. Mazare was handcuffed and driven to the arrest facility of Bucharest Police.

The anti-corruption prosecutors have also started investigations against businessman Sorin Strutinsky, a friend of Radu Mazare’s, currently under arrest in a different matter, charged with three offences of complicity to taking bribe.


DNA: He has caused the state EUR 26 M damages


According to the prosecutors, from 2006 to 2009, Radu Mazare, with the assistance of Sorin Strutinsky, demanded and received approximately EUR 2 M from the officials of two companies in order to facilitate the issuance of urban planning documents necessary for the development of real estate projects – shopping malls the companies intended to build in Constanta.

The sums were transferred as fictitious advertising contracts between the concerned companies and a company under R. Mazare’s control, both directly and through the other defendant.

From 2008 to 2014, Radu Mazare, with the help of Sorin Strutinsky, received from a company over EUR 7 M for helping it with the award of a contract in a tendering procedure organised by the Constanta Municipality for outsourcing the management of municipal sanitation.

At the same time, an agreement was concluded between that company and the public institution headed by Radu Mazare for the outsourcing of the municipal sanitation service for a period of 25 years, with a total estimated price of RON – approximately EUR 35 M.

The damage caused as a result of the operation was RON 112.557.288,88, the equivalent of approximately EUR 26 M, amount which, at the same time, is an undue benefit obtained by the company that received the contract, states the DNA release.


PSD MP Eduard Martin investigated in this case


PSD MP Eduard Martin is investigated in the case in which Constanta Mayor Radu Mazare was detained on Monday for passive bribery and malfeasance in office, sources inform.

Eduard Martin is the owner of the Polaris M Holding SRL sanitation company which paid Radu Mazare a EUR 7 M bribe in order to win a tender. The Constanta City Hall signed a 25-year contract with the company led by the Social-Democrat MP.

Sources quoted by ‘Romania Libera’ daily state that anticorruption prosecutors have started an investigation against him, however the DNA never confirmed the information. At the same time, Digi24 also informed, also quoting unnamed sources, that MP Eduard Martin is allegedly criminally prosecuted in the case that concerns the Constanta Mayor.
