DNA requests detainment and arrest of MP Theodor Nicolescu in Horia Georgescu case

National Anti-corruption Directorate (DNA) prosecutors are asking for the approval of the request to detain and arrest Liberal MP Theodor Nicolescu, who is prosecuted in the case concerning illegal restitution, a case in which Horia Georgescu has been arrested.

The Liberal is accused of passive bribery and three counts of severe malfeasance in office. The request was sent to Prosecutor General Tiberiu Nitu, who will forward it to the Lower Chamber.

The Juridical Commission will analyze the National Anticorruption Directorate’s (DNA) request and will give its consultative vote, with a final decision set to be taken by the Lower Chamber’s plenum.

On Wednesday DNA prosecutors expanded their case against PNL MP Theodor Nicolescu by including a passive bribery charge in the case concerning the illegal restitutions offered by ANRP.

The ordinance that expands the case shows, according to a DNA communiqué, that Nicolescu, who at the time was Vice President of ANRP and member of the Central Commission on Assessing Damages, asked three persons for 5 per cent of the total shares they were about to receive as a result of the conversion of the damage titles included in the ANRP’s restitution files.

In exchange for the money, the PNL MP made sure the restitution files were solved favourably and quickly.

Thus, after solving a restitution case concerning a 20-hectare plot of land located in Bucharest’s District 3, Nicolescu received from 2008 to 2013, from the three persons, approximately RON 6,200,000, representing money and the value of shares. The money was generally offered in instalments of up to RON 250,000, denominated in RON and EUR, and the sum of RON 680,000 was wired through bank accounts on the basis of a fictitious commission contract, DNA points out.

The case concerning the director of the National Integrity Agency (ANI), who resigned after he was arrested on corruption charges, was covered by United Kingdom’s tabloids. Thus, Daily Mail journalists wrote that “Horia Georgescu stepped down as head of the National Integrity Agency, which checks the assets of public officials and rules on conflict of interest and compatibility issues.” “Mr Georgescu was detained and questioned on Monday on suspicion that in 2008 and 2009, he overvalued property being restituted to former owners who lost it when the communists nationalized real estate. Prosecutors said that the allegations center on the value of three large plots of land in the country’s capital of Bucharest. Mr Georgescu, who held a different position at the time of the allegations, has denied any wrongdoing.”


Alina Gorghiu: “He will be suspended from all party offices”


PNL Co-President Alina Gorghiu reacted on Thursday after the DNA asked for the approval of the move to detain and arrest MP Theodor Nicolescu, pointing out that he has resigned from the Lower Chamber’s Juridical Commission. “My colleague has resigned from the Juridical Commission,” Alina Gorghiu stated, being quoted by Stiripesurse. Gorghiu pointed out that Theodor Nicolescu “will be suspended from all political offices held within the party,” as a result of the criminal probe that targets him. In what concerns Nicolescu’s possible resignation from Parliament, Gorghiu stated that that is the MP’s personal decision.
