Dan Nica and Alexandru Athanasiu, prosecuted under judicial control for abuse of office in the ‘Microsoft 2’ case

Former Communications Minister Dan Nica (photo) and former Education Minister Alexandru Athanasiu are prosecuted under judicial control for abuse of office in the ‘Microsoft 2’ case.

Former Communication Ministers Dan Nica and Adriana Ticau and former Education Minister Alexandru Athanasaiu arrived at the National Anticorruption Directorate (DNA) on Monday, being summoned in the ‘Microsoft 2’ case, after President Klaus Iohannis has approved their prosecution for abuse of office.

“Following the fulfillment of the legal and constitutional requirements related to the prosecution against persons who had a Minister position at the date of the deeds, namely after obtaining the approval from the Romanian President, prosecutors of the National Anticorruption Directorate – The Department for fighting against crimes assimilated to the corruption deeds, have ordered the criminal proceedings to be started for the following defendants:

NICA DAN, Minister of Communications and Information Technology from 2000 to July, 2004, for the offense of abuse of office if the public servant has obtained an undue benefit for himself or for another person,

ATHANASIU ALEXANDRU, Minister of Education and Research from 2003 to 2005, for committing the offense of abuse of office if the public servant has obtained an undue benefit for himself or for another person,

TICAU SILVIA ADRIANA, Secretary of State in the Ministry of Communications and Information Technology from 2003 to June, 2004, respectively Minister of Communications and information Technology from July to December 2004, for committing the offense of abuse of office if the public servant has obtained an undue benefit for himself or for another person, in repeated form.

Also, judicial control has been decided for 60 days against the defendants NICA DAN and ATHANASIU ALEXANDRU.

Defendants Athanasiu Alexandru, Nica Dan and Ticau Silvia Adriana have been informed on their quality in the process and on their accusations, as provided by the Art.309 of the Criminal Procedure Code, shows the DNA press release.

“We claim our innocence, we don’t have other statements” said Adriana Ticau when leaving DNA.

“I’ve came into the possession of the documents, which provides me all the necessary elements to prove my innocence”, Dan Nica stated.

“I am under judicial control, I a banned to leave the country. I’ll challenge the decision” stated Alexandru Athanasiu.

By the end of November, President Klaus Iohannis sent to the JustMin the prosecution request on the names of the former Ministers of Communications and information Technology, Dan Nica and Silvia Adriana Ticau, and of the former Minister of Education and Research, Alexandru Athanasiu, in the ‘Microsoft 2’ case.

Former Minister of Communications and Information Technology from 2000 to July 2004, Dan Nica, together with Adriana Silvia Ticau, who was Secretary of State in the Ministry of Communications and Information Technology from 2003 to June, 2004, respectively Minister of Communications from July to December 2004, and Alexandru Athanasiu, the Minister of Education and Research from 2003 to 2005, are suspected of abuse of office if the public servant has obtained an undue benefit for himself or for another person.

Alexandru Athanasiu is accused of initiating and supporting, in his position of Education Minister, the draft of the Government’s Decision no.1778/21.10.2004, for approving the extension of the commercial agreement for licenses lease concluded on 15.04.2004 between the Romanian Government and Fujitsu Siemens Computers GmbH and for the Microsoft educational products, without a justified necessary. Thus, on the one hand, he would have caused a prejudice in total amount of USD 19,370, 500 to the state, and on the other hand, an undue patrimonial benefit, in the same amount, in the favor of Fujitsu Siemens Computers GmbH.

In the ‘Microsoft 2’ file, Claudiu Florica, the former head of Fujitsu in Romania, Silviu Hotaran and Ovidiu Artopolescu, former managers of Microsoft, are accused of complicity in abuse of office, being placed under judicial control for 60 days, starting from November 21.
