*Raluca Turcan accuses Education Minister of “a cascade of illegalities”: “He backdated a document”
Interim President of the National Liberal Party (PNL), Raluca Turcan, accuses Education Minister Pavel Nastase of backdating the Minister’s order which allows school directors who failed to pass at the contest or who didn’t attend to it, to be appointed in office. She added that she will ask for the “guilty person to be criminally held responsible”.
“A cascade of illegalities at the Education Ministry that is completely under PSD’s influence! (…) PSD must answer why the Education Ministry sent the letter no.24187 dated January 6, 2017 to all the inspectorates, instead of sending tem the Minister’s Order? The answer is very simple: there was no Minister’s Order on January 6, 2017! Three days after I warned them about the illegality, they published a backdated Minister’s Order! Therefore, PSD Minister backdated a document just to hide his contempt to the law in force. State authorities should take action, and the guilty persons should be criminally held responsible” Raluca Turcan wrote on Facebook on Tuesday, according to News.ro.
PNL Interim President’s allegations come after the Minister’s Order allowing school directors who failed to pass at the contest or who didn’t attend to it to be appointed in office, was published in the Official Gazette on Monday, January 9.
The order is dated January 6, 2017, although at that date the Ministry issued only a letter with the same content as the order that was published on Monday.
“I was right when I said that PSD changed a Minister’s Order by a handbill without any legal value. On Friday, all the school inspectorates received the letter no.24187 dated January 6, 2017 by which they were free to appoint in office the directors who failed to pass at the contest or who didn’t attend to it, waiting for PSD to come and appoint them on political criteria. They didn’t receive the Minister’s Order, too, for the simple reason that it didn’t exist on January 6, 2017! Only yesterday evening, on January 9, 2017, they published in the Official Gazette no.20/01.09.2017 (Part I) the Minister’s Order no.3044 which takes the information from the letter of Friday. I warned them that they did an illegality. They knew that they are doing an illegality. Now, they covered an illegality with another illegality” Raluca Turcan also claims.
Education Minister Pavel Nastase stated on Saturday for News.ro that he decided that the person who didn’t pass the content for directors, but who previously occupied these seats, can be temporarily appointed in these positions until a new contest will be held, because all the schools in Romania must have directors starting with Monday.
Pavel Nastase stated that he received complaints from the National Council for Fighting against Discrimination, according to which a letter of the former Minister Mircea Dumitru forbidding the persons who were previously school directors and deputy directors and didn’t attend to the contest, as well as the persons who attended to the contest but who failed to pass, to be appointed in the positions remained vacant after the contest.
Education minister Pavel Nastase stated on Saturday that he decided that the persons who failed to pass the content for the directors but who previously occupied these seats, can be temporarily appointed in these positions until a new contest will be held, because all the schools in Romania must have directors starting on Monday, according to news.ro. Nastase stated that he received complaints from the National Council for Fighting against Discrimination, according to which a letter of the former Minister Mircea Dumitru forbidding the persons who were previously school directors and deputy directors and didn’t attend to the contest, as well as the persons who attended to the contest but who failed to pass, to be appointed in the positions remained vacant after the contest.
Pavel Nastase stated that the decision refers to 358 seats of Director remained vacant after the contest (5.59 percent of the total of more than 6,600 seats), and 308 seats of Deputy Director, in the whole country.
The new Education Minister mentioned that the decision is temporary, because a new contest will be held in June or at las in July, for the vacant seats of Director and Deputy Director.
“By September 1, I would like the problem to be fairly and transparently solved, through a contest”, the Minister stated. He added that in the coming period, a methodology will be prepared, a schedule will be approved and a bibliography will be announced in order to hold the contest.
Teachers who didn’t pass the contest for the Director and Deputy Director seats can be appointed in these positions “through assignment in the Education’s interest”, according to a letter issued on Friday by the Education Minister, obtained by Ziarul de Iasi. According to the quoted document, the appointment will be made by the General Inspector, with the approval of the inspectorate’s Board.
Presidential Administration also criticized the Education Ministry’s decision. State Counselor Ligia Deca, the head of the Education Department of the Presidential Administration, stated on Monday that the decision of appointing the directors of the educational units by derogation is an “extremely negative signal” in the system, since those who proved that they didn’t have performances are rewarded, and that the decision has been taken as a result of the “pressure” from the former directors who lost their seats.
State Counselor of the Presidential Administration: Education Minister admitted that validating the directors by a contest is necessary
State Counselor Ligia Leca, the head of the Education and Research Department of the Presidential Administration, underlined that Education Minister Pavel Nastase admitted that validating all the directors of school units by a contest in the future is absolutely necessary.
“Indeed, I talked to the Minister Pavel Nastase on the situation of appointing former school directors who didn’t attend at the contest or who failed to pass it. We received assurances that we’ll be provided with the record of such exceptional appointments, with the reasoning for each case, which clearly shows the understanding of the subject by both parties. From the start, the discussion focused on the cases where there are no directors appointed by winning the contest, and the Minister admitted that there is absolutely necessary to validate all the directors by a contest in the future” Ligia Deca stated for Agerpres.
She underlined that Presidential Administration is waiting for the record requested from the National Education Ministry, in order to clarify the necessity and the opportunity of these appointments.
“I continue to appreciate that there’s hard to believe that in cities like Bucharest we can’t find persons who can be temporarily appointed as directors besides those who failed to pass the contest or who didn’t attend to it”, added the State Counselor.
National Education minister Pavel Nastase stated on Monday that he discussed with the State Counselor Ligia leca about the issue of appointing the directors of educational units by derogation, ad things have been clarified.
“We received it from the Presidency also, we discussed, everything’s clear. It was a misunderstanding. Everybody thought that we will cancel the contest, that we’ll appoint those who previously had these positions. No seat will be taken otherwise than by contest, it can’t be taken by appointment anymore. The appointment is only temporary. In the event that someone is ill, the General inspectorate assigns, it temporarily appoints somebody else until the holder of the seat comes back” stated Education Minister Pavel Nastase for Agerpres.
Ligia Deca previously announced that Presidential Administration requested the Education Minister Pavel Nastase to provide it with the record of the directors of educational units who are appointed by derogation, mentioning that a general derogation is inopportune.
“We hope that those who will be appointed will have a short-term appointment, and only if other solution isn’t possible. We do not wish in any way to give a signal into the system that you can return to the Director seat even if you ignore a contest which aims exactly to professionalize the school management”, stated the Head of the Education Department of the Presidential Administration, Ligia Leca, for Agerpres.

Former President Traian Basescu also criticized Education Ministry’s decision to allow the appointment of the school directors without a contest, labeling it as a “boundless baseness”.
“The boundless baseness of the National Education ministry. One of the most important things that Mircea Dumitru –the former Education Minister – did is related to the organization of the contest for the school director seats. The result of the contest was that 3,509 directors appointed by PSD failed to pass the exam and they cannot be school directors. What do the new Education dignitaries Liviu Pop and Pavel Nastase do, through orders given in the territory? No more no less than reinstalling the 3,509 directors who failed to pass the exam and announcing the 5,405 directors who passed the director exam that they are only interim directors, therefore they can be replaced anytime. It’s such a rare baseness. And you should see what will happen with the doctorates…” Traian Basescu wrote on Facebook on Sunday.
