Speaker Tariceanu still wants chief corruption prosecutor Kovesi to resign for serious constitutional violations

Senate Speaker Calin Popescu-Tariceanu said Sunday that he still believes chief prosecutor with the National Anti-Corruption Directorate (DNA) Laura Codruta Kovesi should resign following the Constitutional Court’s ruling that Kovesi has interfered with the activity of the government.

“I say once again what I have already stated: following the ruling of the Constitutional Court severely reprimanding DNA for its interference with the activity of the Executive – something that you should know occurs not just in Romanian politics, but also elsewhere in Europe as my counterparts, senate chairs, told me one week ago in Rome; they all felt consternated by that. I said it would have been normal for Mrs Kovesi to resign office, because in the end that betrays something different from lack of knowledge of constitutional fundamentals. I have not changed my opinion, because we are talking about serious constitutional violation,” Tariceanu, also co-chair of the Alliance of Democrats and Liberals (ALDE) told Digi 24 private broadcaster on Sunday.

He went on to say that condoning such actions entails Kovesi’s taking responsibilities.

“This is not a joke regarding the attitude of some prosecutor. As chief prosecutor, when condoning such actions you take some responsibility. And that, as I was saying, was about a serious violation of the principle of separate state powers, un unpermitted interference of a component of the judiciary with the exercise of power by the Executive,” said Tariceanu.

He added that the controversial provisions in government emergency ordinance GEO  13 were not illegal, because they defined abuse of office as required by the Venice Commission.

“While we know what has happened in terms of public communication, of action stirring up emotions, legally there was nothing wrong, since the Constitutional Court has not censored it. (…) CCR did not rule on merits, but in the end it did rule because it received my complaint against the DNA action, which, as you may already know, has been called a serious abuse. (…) DNA’s action was not some figure of speech; it attempted to penalise what the Government supposedly did wrong. But it did no wrong because, as far as the provisions in the ordinance went, there was nothing illegal. It is something else altogether that some exaggerated by arguing the ordinance would decriminalise abuse of office, which was not the case as it merely redefined it in line with the requirements from the Venice Commission. But, unfortunately, in politics we act on perceptions instead of on realities,” Tariceanu concluded.


Basescu: Codruta Kovesi might be a competitive alternative for Klaus Iohannis in the presidential elections of 2019


The leader of the People’s Movement Party (PMP), Traian Basescu, commented on Friday night for B1 TV the article published by the LeMonde journalists, who made a top of the politicians in growth in Europe, in which Laura Codruta Kovesi ranks fourth; the former President said that the Head of the National Anticorruption Directorate (DNA) might be a competitive alternative for Klaus Iohannis in the presidential elections of 2019.

“I haven’t seen the article, but if she is among the politicians who have a future, it means that those from LeMonde have made a consistent analysis and they have understood that she has approaches of a politician, not of a prosecutor. For the position she holds, it’s a very bad signal, because it indicates that she is seen like this. It’s obvious that Mrs. Kovesi is a politician with a future, provided that no breaches of the law will be find in her work” Basescu stated.

Being asked where he sees Mrs. Kovesi in the future if she will be dismissed from DNA, the former President answered: “In the prosecution. I guess she will not leave her profession that she says she loves very much. She had enough years as a leader. She should rest now. I don’t believe she was born to be only a boss”.

Also being asked if there is any possibility for the current Head of DNA to run for President in 2019, Basescu stated: “She can run, why not? Anyone who enrolls in a competition has his or her chance. It’s hard for me to assess now how the battle for the President will be in 2019. Obviously, right now, there is no competitor except Iohannis. (…) Therefore, Mrs. Kovesi might be a competitive alternative for Iohannis”.

The former President claims that the PSD leader Liviu Dragnea wouldn’t have any chance in the presidential elections of 2019 and he warned that it’s too late for politicians to appear in order to win these elections.

“Politicians who can win presidential elections cannot be made in one year” the former Head of State explained.
