Traian Basescu’s lawyers asked for the reopening of the Flora case to be judged by the Supreme Court

Traian Basescu’s lawyers asked on Thursday to the Bucharest Court’s judges to establish that the decision on the reopening of the Flora case must be taken by the Supreme Court, given that the former President is a Senator; judges adjourned the decision on this request.

Traian Basescu didn’t come to the Bucharest Court at the Thursday’s hearing, which lasted around 15 minutes, but his lawyers asked the trial to be moved at to the High Court of Cassation and Justice, since their client is a Senator.

Judges adjourned the decision on the request made by Traian Basescu’s lawyers.

Thus, Bucharest Court’s judges will decide if they send to the Supreme Court the case referring to the confirmation of reopening the prosecution in the case in which the former President Traian Basescu is accused of restituting, in 2003, when he was the Bucharest Mayor, a land of 40,000 square meters located in Damaroaia, on which the former MP Dumitru Puzdrea built the Flora Shopping Center.

The case was postponed two weeks ago, because the former President was summoned at the Cotroceni Palace, instead of his current domicile.

Former President Traian Basescu was also summoned by the Bucharest Court on May 24, 2016, iin the same case, opened following a complaint for abuse of office, filed by the Vice President of the Union of Arabs in Romania, Catalin Nastase, Dumitru Puzdrea’s former business partner.

According to Catalin Nastase’s complaint, Traian Basescu committed the offense of abuse of office when he approved the restitution of the land located in the Damaroaia area, in the 1st District of Bucharest, causing a damage of approx. EUR 100 million.

The plaintiff challenged the duration of the trial in which Traian Basescu is a respondent, but Catalin Nastase wasn’t present at the hearing on May 24, 2016.

“Are there still many of those who file complaints in 2015 for 2003? I will fight against them at the court anywhere”, Basescu said in the courtroom.

The former President stated at the end of the hearing that this is a complaint since 2015 related to a restitution since 2003.

“I haven’t lost any restitution trial yet, so I’ll not lose this one either. I don’t know Catalin Nastase, I haven’t seen him, I see he didn’t come. He files a complaint and he doesn’t come at the hearing” Traian Basescu added.
