Viorel Hrebenciuc, acquitted in the case in which he is accused of perjury for his statements in the case “Bribery at PSD”

1st District Court decided on Monday to acquit the former PSD MP Viorel Hrebenciuc in the case in which he is accused of perjury for false statements in the case “Bribery at PSD”. The acquittal decision is not final and it can be challenged by the prosecutors to the Bucharest Court.

“Orders the acquittal of the defendant Hrebenciuc Viorel in relation to the offense of repeated perjury provided by Article 273 para. 1 of the Criminal Code, pursuant to the Article 35 para. 1 of the Criminal Code and Article 5 of the Criminal Code (material acts dated October 25, 2011 and June 26, 2013)” states the court’s decision.

The decision can be challenged by prosecutors to the Bucharest Court, whose decision will be final in this case.

Viorel Hrebenciuc was sent to judgment by the prosecutors of the Prosecution Office attached to the 1st District Court in June, 2016, being accused of perjury for false statements in the case “Bribery at PSD”, in which businessman Ioan Niculae and the former President of the Braila County Council, Gheorghe Bunea Stancu, have been convicted.

Prosecutors claimed that in the autumn of 2011, Viorel Hrebenciuc made false statements when heard as a witness by DNA, in the case “Bribery at PSD” on financing the electoral campaign of Mircea Geoana, the PSD candidate in the presidential elections of 2009.

“As a result of the fact that the said Hrebenciuc Viorel didn’t tell the truth related to the issues for whose probation he was heard as a witness, related to the deed committed by the said Ioan Niculae, 1st District Court of Bucharest ordered the acquittal of the defendants Ioan Niculae, Bunea Stancu Gheorghe, Teodorescu Gheorghe and Barac Viorel”, according to the prosecutors.

Investigators claim that later, on March 19, 2015, when heard as a witness at the Bucharest Court of Appeal, in the case “Bribery at PSD”, Viorel Hrebenciuc told the truth. Following these statements, Ioan Niculae was finally sentenced to two years and six months of imprisonment, while the former President of the Braila County Council, Gheorghe Bunea Stancu, was sentenced to three years of imprisonment.

“Geoana personally sent me to Niculae to ask him to help finance the campaign. I found out later that a contract has been concluded between Interagro and INSOMAR on the situations of the buildings in Romania. The payment was made for Geoana’s surveys” stated Hrebenciuc at that time.

Ioan Niculae is paroled since July 15, after he made, starting from April, 2015, a part of the sentence of two years and six months of imprisonment, received in the case “Bribery at PSD”.
