Dragnea to take action to ECHR and ECJ regarding “Referendum” case

The leader of the Social Democrat Party (PSD), Liviu Dragnea, stated o Thursday, at the Parliament, that he will challenge the decision of the High Court of Cassation and Justice rejecting his opposition to enforcement related to the decision in the “Referendum” case, to the European Court of Human Rights (ECHR) and European Court of Justice.

“This approach, finalized, as expected, by rejecting the opposition, gave me back the possibility to make two approaches at ECHR and European Court of Justice in Luxembourg. The complaints are almost ready and very soon, my lawyers in this case will submit them to the two European courts”, Liviu Dragnea stated.

The panel of five judges rejected on Monday the opposition to enforcement submitted by the PSD President Liviu Dragnea in the “Referendum” case, considering that it is ungrounded. The court’s decision is final.

Judges also ordered Liviu Dragnea to pay RON 100 as court costs.

Liviu Dragnea’s lawyers asked the court, at the last hearing, to approve the opposition to enforcement, claiming that the reasoning of the final decision in the “Referendum” case wasn’t drafted in 30 days since the decision was issued, and at the date of the reasoning, the Chairman of the panel who solved the case wasn’t a judge anymore, since she retired before. They stated that they do not invoke the lack of signature of the panel’s President, Livia Stanciu, on the reasoning, but the total absence of the judge when the decision was drafted, given that she was no longer a judge in February, 2017, since she retired before.

The prosecutor of the National Anticorruption Directorate (DNA) asked the court to reject the opposition to enforcement, since the legal requirements are not fulfilled.

In his last word, Liviu Dragnea said he witnessed a debate that surpassed him, since he is an engineer, but noted that the DNA prosecutor said that a law provision is a recommendation.

“As far as I know, the reasoning should have been drafted within 30 days. I do not think my approach was exaggerated. I was sentenced for something which I was not accused of in the indictment. I wanted to see if this decision is the result of the participation of all members of the panel” Dragnea stated at that time.

On April 22, 2016, Liviu Dragnea was sentenced to two years of suspended prison in the “Referendum” case.

 

Speaker Dragnea says will discuss in Parliament and with President about Romania’s path in EU

 

Deputies’ Chamber Speaker Liviu Dragnea on Thursday said that he will discuss with President Klaus Iohannis about Romania’s path in the European Union, on May 9, when the head of state addresses Parliament, as well as when he honors the invitation he was extended on going to the Cotroceni Presidential Palace.

“I will not miss this opportunity to exchange a few words. Moreover, I also received an invitation to Cotroceni then [on May 9] or when Mr Juncker comes and I will use the two occasions,” Dragnea said at the Palace of Parliament, asked if he would talk with President Klaus Iohannis about his intention of initiating consultations on the topic of Romania’s path in the European Union.

Referring to Romania’s development strategy on the next 25 years, he showed that the best idea is for it to be endorsed by the Romanian Academy.

“I was invited to an important action of the Romanian Academy that has worked for about two years on an extremely important document – namely Romania’s development strategy for the next 25 years. I believe that we must start from that document and I believe that the Romanian Academy can be the institution gathering around it the political decision makers, specialists, political parties, in order to succeed to make operational that document which is a wide one and draw up a roadmap for this country, after we have defined the main strategic objectives. Yesterday, I talked to Mr Tariceanu about it, next week I hope we have a meeting and be received by the Academy President and there we can establish what the actual course of this action is. It is a good idea for the Romanian Academy to endorse this action so there aren’t any reserves from anyone generated by a certain possible loss of political capital,” Dragnea mentioned.

Deputies’ Chamber Speaker Liviu Dragnea in Parliament proposed a consultation among all political parties for establishing the essential benchmarks which Romania must follow in front of the special challenges on the level of the European Union.
