SRI becomes civil party in Hexi Pharma criminal case asking for 12,600 lei in damages

The Romanian Intelligence Service (SRI) has become a civil party to a criminal case involving the Hexi Pharma biocide maker, claiming 12,600 lei, VAT included, in damages for contract 90/3 of January 26, 2016 terminated on February 3, 2016 by Military Unit 0502 Bucharest, SRI said in a Facebook post on Friday.

The Agrippa Ionescu Hospital is being reported to have returned to Hexi Pharma the products acquired, and consequently the company canceled the receipts attesting to the payment.

“On August 11, 2016, Hexi Pharma Co SRL confirmed the existence of a RON-12,314.16 debt to our unit. Consequently, our hospital unit is the owner of a certain, liquid and eligible liability due to it by Hexi Pharma Co SRL, which the company voiced readiness to settle,” reads the SRI post.

On March 6 , Hexi Pharma was sent to court by the Prosecution Service with the Supreme Court of Justice for 340 counts of fraud (six of which have very serious consequences), use of misrepresentation (61 counts), as well as for improper participation in the offence of hampering disease combat.

Also sent to court in the same case were Hexi Pharma CEO Flori Dinu for misrepresentation in signed documents (49) improper participation in the offence of hampering disease combat, as well as Hexi Pharma product manager Mihai Leva, for misrepresentation in signed documents (33 ) and being an accessory to improper participation in the offence of hampering disease combat.

The Prosecution Service said in a press statement back then that June 1, 2010 – May 16, 2016, Hexi Pharma misled officials of 340 healthcare facilities by misrepresenting the dosage of active substances and biocidal efficiency of its own products as well as the use of fraudulent means in the form of labels and other written information attesting to compliance elements that were in fact false, thus misleading the officials into concluding procurement contracts for non-compliant biocides and incurring a damage on them in the process.

Likewise, October 12, 2012 – March 9, 2016, Hexi Pharma used misrepresentation in 61 written documents used for communication with the National Biocides Commission – product sheet, security compliance sheets and active substance declarations – in order to win market release for its products.

Chief prosecutor of the Criminal Investigation Section of the Public Prosecution Service Romulus Varga has set the damage in the Hexi Pharma case at 102 million lei, but some hospitals have withdrawn from the case as civil parties.
