Laura Codruta Kovesi, subject to a disciplinary investigation of the Judicial Inspection, together with other two prosecutors

Judicial Inspection started a disciplinary investigation related to the DNA leadership, as a result of the complaints of the revoked DNA prosecutors Mihaiela Iorga Moraru and Doru Tulus

The judicial inspectors have started the disciplinary investigation against prosecutors Laura Codruta Kovesi, the Chief-Prosecutor of the National Anticorruption Directorate, Marius Iacob, who is the Deputy Chief-Prosecutor of DNA, and Gheorghe Popovici, Chief-Prosecutor of a DNA Department” reads a document presented on Monday by luju.ro.

The documents mention that the complaint, to which other complaints with a similar subject were joined, was assigned to be resolved by the Judicial Inspection Directorate for Prosecutors.

Judicial Inspection sates that, at the end of the disciplinary investigation, depending on the result of the verifications, the judicial inspectors can order either the approval of the complaint, by the exercise of the disciplinary action, and the notification of the Department for prosecutors in disciplinary matters belonging to CSM, or the rejection of the complaint, if they find that the requirements are not fulfilled in order to exercise the disciplinary action.

According to Agerpres, prosecutors Doru Tulus, Mihaiela Moraru Iorga and Nicolae Marin have filed a complaint to the Judicial Inspection, complaining about the way in which the internal investigation was conducted after a recording with Chief-Prosecutor Laura Codruta Kovesi at a working meeting of DNA was published.

On June 29, the head of DNA, Laura Codruta Kovesi, sent to the CSM Department for Prosecutors the request to approve the revocation of Mihaiela Iorga Moraru, for the reason that she didn’t registered a denunciation according to the legal provisions and she failed to present it to be assigned by the chief-prosecutor of the department in which she was working. Failing to present the denunciation had the result consisting in the impossibility of applying criminal procedural provisions related to the investigated persons.

Kovesi also requested the revocation of Doru Florin Tulus “for the existence of a reasonable suspicion that his impartiality is affected, given that he solved criminal cases in which a person with whom he had civil relations was involved”.

On July 4, the CSM Department for Prosecutors approved the revocation of the DNA prosecutors Doru Tulus and Mihaiela Moraru Iorga. The measure was appealed by the two prosecutors, but unsuccessfully, because the members of the Superior Council of Magistracy (CSM) rejected, on September 14, the objections raised by the prosecutors Doru Tulus and Mihaiela Moraru Iorga.
