President Iohannis files constitutional challenge to repeal of indicted public servants’ suspension from office

President Klaus Iohannis sent on Monday to the Constitutional Court of Romania a challenge to the Law amending and supplementing Law No. 188/1999 on the public servants’ statutes. The respective piece of regulation maintains the repeal of the provision according to which public servants who are indicted for various crimes – corruption and malfeasance on the job included – are suspended from office.

“Having regard of the scope of the regulation, and the content of the regulation, we consider that the Law amending and supplementing Law No. 188/1999 on the public servants’ statutes runs counter to the Constitution and is therefore unconstitutional,” argues the President in the constitutional challenge.

President Iohannis mentions that the repeal of the public servant’s suspension from office following the indictment is in breach of the provisions of the Constitution.

On November 14 the Chamber of Deputies adopted the bill amending Law No. 188/1999 on the public servants’ statutes, maintaining the repeal of the provision according to which public servants who are indicted for various crimes – corruption and malfeasance on the job included – are suspended from office.

The Chamber of Deputies thus rejected the objections raised by President Iohannis in his request for the revision of the bill which initially cleared Parliament in June 2016.
