President challenges modifications brought to Law no. 304/2004 on judicial organization with CCR

President Klaus Iohannis on Thursday challenged with the Constitutional Court of Romania (CCR) the modifications and supplements brought to the Law no. 304/2004 regarding judicial organization, the Presidential Administration has made an announcement.

The normative act was submitted to the President by the Parliament for promulgation on June 22 2018.

“In our opinion, the abovementioned law was adopted in violation of the provisions of art. 77 paragraph (2), art. 64 and 147 paragraph (4) of the Constitution. Moreover, by corroboration with art. 77 paragraph (2) of the Fundamental Law, the Law on the modification and supplementation of the Law no. 304/2004 on judicial organization was adopted in violation of the provisions of art. 1 paragraph (4) and art. 61 paragraph (1) corroborated with art. 80 paragraph 92) of the Constitutions,” argues Iohannis, in detailing a series of reasons.
