Carmen Dan, issues a negative opinion on Kovesi’s protection: There is an alternative for the protection of those who are no longer dignitaries, including if they are threatened

The Minister of Internal Affairs Carmen Dan was asked on Saturday why she issued a negative opinion on the protection provided from now on by the Guard and Protection Service (SPP) for the former head of the National Anticorruption Directorate (DNA), Laura Codruta Kovesi. She answered that each member of the Supreme Council of National Defense (CSAT) has the freedom of his or her own options, and there is an alternative for the guard and protection of those who are no longer dignitaries, including when they feel that they are threatened or in a danger situation.

“Each CSAT member has the freedom of his or her own options. As you know, the communication is made by the Presidential Administration, but I admit that by expressing my option, I also said that there is an alternative for the guard and protection of those who are no longer dignitaries, including when they feel that they are threatened or in a danger situation. There are provisions in this regard, and the Law no.303, as well as the Law no.550 on the organization and functioning of the Romania Gendarmerie state very clearly what are the competences of this institution” Carmen Dan stated.

The Minister of Internal Affairs said that there are certain strict requirements that determine the conduct of a CSAT member.

“Despite any other speculations, each member has the freedom of his or her own option” she added.

Article 3, paragraph 5 of the Law no.303 on guarding the objectives, goods, assets and on the protection of persons, provides: “The protection of the magistrates, police officers and gendarmes, as well as of their family members, in the cases in which the life, the body integrity or the assets of these persons are subject to any threats, is provided by the Ministry of Internal Affairs, according to the law”.

Article 19, paragraph 2 of the Law no.550/2004 on the organization and functioning of the Romanian Gendarmerie, states that “upon the request of the individuals or legal persons, in cases of no delay, at the proposal of the General Inspector, the Ministry of Administration and Internal Affairs can approve the temporary protection of certain persons, objectives goods, assets and special transportations, other than the ones established by the Government’s decision, according to the law”.
