PM Viorica Dancila announced on Monday that the National Executive Committee (CExN) of PSD has unanimously voted for the issuance of Emergency Ordinances (GEO) on the Criminal Codes.
“There was such a discussion within CEx, it was unanimously decided to appreciate the opportuneness to promulgate by emergency ordinance the articles that have been declared constitutional”, Dancila stated.
Asked why an GEO was needed, instead of considering the solution to prepare a draft law, Prime Minister explained that this option was considered because other laws were challenged, and it took a long time until they entered into force.
“We saw that so many laws took so long, they have been challenged, they have ben sent to the Constitutional Court, it was a long legislating process, but as for the adoption of these laws, the term was far exceeded. We talked about this opportuneness”, Prime Minister answered.
Viorica Dancila mentioned that the adoption of an emergency ordinance is taken into account for the Criminal Code, as well as for the Criminal Procedure Code, and it was decided that “we should have the possibility to issue a GEO on what was declared constitutional”.
“You know very well that when the Constitutional Court decides that an article, a law, is constitutional, it becomes binding for everyone, therefore we had this discussion starting from this reason”, Dancila explained.
Dancila said that the articles of the Criminal Code and Criminal Procedure Code that have been declared unconstitutional will be referred back to the Parliament.
Prime Minister said she cannot mention a term within which the GEO will be adopted.
“I can’t say anything, since we haven’t talked about a term”, she said.
