The Bucharest Court ruled on Wednesday that Hexi Pharma pay a damage of approximately 125 million lei, representing the value of non-compliant biocidal products purchased by hundreds of hospitals around the country, in the criminal case in which Director of the company Flori Dinu was sentenced to three years in prison.
According to the court ruling, Hexi Pharma was forced to pay 89 million lei (82 million lei and 1.5 million euro) to 128 hospitals, which became civil parts in the case.
Moreover, the Bucharest Court decided to seize 36 million lei from Hexi Pharma, obtained by the company from 205 state and private hospitals around the country, that haven’t become civil parts in the case.
On the other hand, the Bucharest Court ordered Hexi Pharma to pay a criminal fine worth 2.6 million lei for committing the offenses of fraud, use of forgery and improper participation in hindering disease treatment.
The Court also decided the dissolution of the company after the court ruling remains final.
In addition, the court imposed preventive measures to the company, for a period of 60 days, including: the prohibition to initiate the dissolution or liquidation procedure; the prohibition of starting a merger, division or reduction of the share capital; prohibiting of disposing of the company assets, except raw materials and packaging in its stock; prohibition of payments and transfers, except those necessary for the payment of utilities, wages, maintenance, raw materials, contributions to the consolidated state budget; banning the production and marketing of biocidal products.
In March 2017, the Hexi Pharma company was sent to court by the Prosecutor’s General Office for committing 340 fraud offenses (of which seven with very serious consequences), use of forgery (61 material acts), as well as for improper participation in hindering disease treatment.
