BEC rejects registration of the USR – PLUS electoral alliance for the EP elections .Ciolos: It’s an insult against the voters and a totally undemocratic act. PSD and ALDE destroy the elementary principle of democracy . PSD reacts, asks USR and PLUS to stop blaming others for their own incompetence

The registration of the electoral alliance called Alianta 2020 USR – PLUS (The Alliance 2020 USR – PLUS – e.n.) for the EP elections of May 26 was rejected on Thursday by the Central Electoral Bureau (BEC). The PLUS leader Dacian Ciolos said it’s an insult against the voters and a totally undemocratic act, and warned that the two parties will make the necessary steps and will protest “until this undemocratic and illegal action will be removed”.

BEC’s pretext was that Dan Barna and Dacian Ciolos are not registered as the Chairmen of USR, respectively PLUS, in the Register of the Political Parties, PLUS mentioned.

Both parties say they requested the registration of their chairmen at the Bucharest Court, but they haven’t received a final decision until today, and for this reason, BEC rejected the registration request of the Alliance.

“It’s a political decision made under the pressure of the corrupt regime established by Liviu Dragnea in Romania. The legal documents we submitted didn’t matter. The legal decisions of the two parties and the will of the 14,000 didn’t matter. The 200,000 signatures we gathered also didn’t matter. The rejected our request because Liviu Dragnea is afraid of the Alliance 2020 USR PLUS, of ‘No More Criminals’, of ‘New People’, he is afraid of everything that this Alliance means and all the hopes related to it.

Today’s decision of the Central Electoral Bureau means only one thing: they want, at any cost and by any means, to prevent us from running in the elections. First, they tried for months to prevent the registration of the Romania Together Movement (RO+). This time, they are blocking the Alliance 2020 USR PLUS for absurd and totally undemocratic reasons. Our right to be voted, as well as the Romanians’ right to vote are violated. It is for the first time, after 1990, when a list which benefits from the support of approximately 20% of the Romanians, according to the polls, is rejected”, the representatives of the two parties appreciate.

They believe this is a profoundly undemocratic act which is an attempt to remove the alliance from the electoral process.

“What happened at BEC is an unpermitted politicization of a body that would maintain the democratic balance”, the representatives of the Alliance concluded, announcing that they will appeal the decision to the High Court of Cassation and Justice (ICCJ).

Later, Dacian Ciolos wrote on Facebook: “It’s an insult against the voters and a totally undemocratic act. PSD and ALDE, together with their satellites, destroy the elementary principle of the democracy by violating the right to candidate and be elected. We will make all the necessary steps and will protest until this undemocratic and illegal action will be removed. Since our first announcement that we are going to enter politics, until today, we are the target of the dirtiest attacks. When they saw they cannot intimidate us, they started to politically manipulate the state institutions. I make a call to all the PLUS and USR members to be solidary and fight against this undemocratic act”.

The USR PLUS Alliance was announced on February 2.

Nicolae Stefanuta (USR), 7. Vlad Botos (USR), 8. Ramona Strugariu (PLUS), 9. Vlad Gheorghe (USR), 10. Alin Mituta (PLUS), 11. Anamaria Naomi Reniut (PLUS), 12. Valeriu Nicolae (PLUS), 13. Oana Toiu (PLUS), 14. Radu Ghelmez (USR), 15. Liviu Iolu (PLUS).

 

Dan Barna and Dacian Ciolos are not the USR and PLUS Chairmen according to the articles of incorporation of their parties

 

Dan Barna and Dacian Ciolos are not mentioned in the articles of incorporation of USR, respectively PLUS, registered at the Bucharest Court. BEC rejected the registration request of the USR-PLUS Alliance on the ground that the Chairmen of the Alliance are not the same with the Chairmen of the parties.

“The composition of the managing, arbitration and control bodies of the Save Romania Union: The National Bureau: Nicusor Daniel Dan, Cristian Ghica, Roxana Sanda Wring, Dumitru Dobrev, Clotilde Marie Brigitte Armand Moroianu, Florin Grigorescu, Cristian-Gabriel Seidler, Ana-Maria Ciceala, Florin-Cristian Cobzac,Florin-Ciprian Dinica, Cristina Coroblea. Chairman: Nicuşor Daniel Dan”, reads the articles of incorporation published on the website of the Bucharest Court, at the Political Parties section.

At the same time, the articles of incorporation of the Liberty, Unity and Solidarity Party (PLUS) mention only the founding members of the party: Florina Raluca Danes – Chairperson, Iulia Iordache – Vice Chairperson, and Alexandru Adrian Iordache – Secretary General, according to the quoted source.

The steps to establish a political alliance require the submission of a protocol for its establishment at BEC within 48 hours since it was established, according to the Law no.33/2007 on organizing and carrying out the elections for the European Parliament, republished, as subsequently amended.

“Political parties, political alliances and the organizations of the citizens belonging to the national minorities can associate between them only at national level, based on a protocol, forming an electoral alliance, in order to participate in the elections for the members from Romania of the European Parliament. A political party, a political alliance or an organization of citizens belonging to the national minorities can be part of a single electoral alliance. The Protocol for establishing the electoral alliance must be submitted to the Central Electoral Bureau within 48 hours since it was established”, the law states.

BEC’s decision by which a protocol is rejected can be appealed at the High Court of Cassation and Justice, which delivers its solution within 24 hours since it was registered, according to the above-mentioned Law.

“The Central Electoral Bureau delivers its decision in public session on the admission or rejection of the protocol for establishing an electoral alliance, within 24 hours since it was registered. The decision of the Central Electoral Bureau related to the admission of the protocol for establishing the electoral alliance can be appealed by any interested individual or legal person, at the High Court of Cassation and Justice, within 24 hours since it was published. The High Court of Cassation and Justice delivers its solution on the appeals provided by par.(4) and (5) within 24 hours since the appeal was registered, by a final decision”, the Law no.33/2007, updated on February 13, 2014, also provides.

 

PSD asks USR and PLUS to stop blaming others for their own incompetence

 

On Thursday, the Social Democrats asked USR and PLUS, on Facebook, to stop blaming others for their own incompetence and for the fact that the legal procedure for registering the two parties wasn’t observed.

“The reason for the rejection of the alliance is purely legal, namely the fact that the legal procedure for the registration of the two parties in the Register of the Political Parties wasn’t observed. This legal reality was established by a wide majority within the Central Electoral Bureau, including by the 5 judges who are part of this decisional body”, was the Facebook message sent by Social Democrats on Thursday.

“If USR and PLUS believe their rights have been breached, they have to trust the justice and use the legal remedies to defend their point of view. Until then, a question remains, which the citizens of this country have to put: How could Romania be governed by USR and PLUS, since they are not even able to register their own parties, as requested by the law?” the quoted source added.

 

Olguta Vasilescu: USR minus PLUS think that everything that goes wrong for them must come from PSD

 

Olguta Vasilescu stated that “the guys from USR minus PLUS” think that everything that goes wrong for them is caused by PSD and Liviu Dragnea, ironically mentioning that it’s not their fault for their inability to interpret a law.

“The guys from USR minus PLUS think that everything that goes wrong in their lives must come from PSD and Dragnea! It’s not their fault for not knowing how to interpret a law and they don’t have any confused guy in their party who prepares their documents wrongly… But the funniest part is that they praised a judge until now for sentencing Dragnea, and today they sent her directly to Dragnea’s group because she rejected the registration of their alliance! Don’t worry, guys, ‘cause Caramitru Jr. will come with an emergency ordinance to register you and abolish us, and things will be solved”, Olguta Vasilescu wrote on Thursday on Facebook.
