CCR: GEO on operationalisation of Section for Investigating Magistrates is constitutional

The Constitutional Court of Romania rejected on Wednesday the notification submitted by the National Liberal Party (PNL)  and Save Romania Union (USR) on the Law approving the GEO on the operationalization of the Department for Investigating the magistrates, deciding that the normative act is constitutional.

The Court rejected with a majority of 6 to 3, the notification submitted by PNL and USR on the GEO 90.2018, by which the Department for investigating Judiciary Offenses became operational.

In December 2018, the Save Romania Union and the National Liberal Party challenged to the Constitutional Court the Government’s Emergency Ordinance no.90/2018 establishing the Special Section  for Investigating the Magistrates. The two parties identified four reasons of constitutional challenges in the adoption process of the ordinance.
